Trump signs executive order seeking to end collective bargaining in some federal agencies
- President Donald Trump signed an order on August 28, excluding several federal agencies and agency subdivisions from collective bargaining rights under U.S. labor law, citing national security concerns.
- The order applies to NASA, the U.S. Patent and Trademark Office, the National Weather Service, NOAA subdivisions (including NESDIS), the U.S. Agency for Global Media and hydropower units in the Bureau of Reclamation.
- The order amends Executive Order 12171 (1979) and invokes Section 7103(b)(1) of Title 5, allowing exclusions for agencies with national security functions.
- The White House claims union procedures can delay agency operations, hindering their ability to act swiftly on national security matters.
- This move reflects Trump’s broader agenda to reduce federal union influence, which he argues hampers government efficiency and responsiveness.
President Donald Trump has signed an executive order formally excluding several federal agencies and agency subdivisions from collective bargaining rights under U.S. labor law, citing national security interests.
The order, titled “Further Exclusions from the Federal Labor-Management Relations Program,” affects agencies whose primary missions involve intelligence, investigative or national security work. The order will apply to several federal departments and agency subdivisions, including the U.S. Agency for Global Media, National Aeronautics and Space Administration (NASA), the U.S. Patent and Trademark Office (USPTO), the National Weather Service (NWS) and components of the National Oceanic and Atmospheric Administration (NOAA).
The administration argued that these agencies handle sensitive technology, data and operations that intersect with national defense, intelligence and global strategic interests, making the standard federal labor-management framework incompatible with their missions.
In a fact sheet released alongside the order, the White House said that delays created by procedural requirements in federal labor-management relations can impact the ability of agencies with national security responsibilities to “implement policies swiftly and fulfill their critical missions.” (Related: Trump signs executive order to halt ALL foreign aid programs.)
“Certain procedural requirements in Federal labor-management relations can create delays in agency operations. These delays can impact the ability of agencies with national security responsibilities to implement policies swiftly and fulfill their critical missions,” the fact sheet read.
Additionally, the order includes a provision extending the deadline for related actions by the Secretaries of Defense and Veterans Affairs, ensuring prior executive actions regarding labor exclusions can still take effect within a 15-day window.
The order, signed on Aug. 28, is effective immediately.
Trump amends Executive Order 12171 to strip union rights
Brighteon.AI’s Enoch defines collective bargaining in federal agencies as the process by which labor unions negotiate with employers on behalf of their members to establish the terms and conditions of employment.
This process engages employers in these negotiations with the union chosen by a majority of the employees in a designated bargaining unit. The outcomes of these negotiations typically include agreements on wages, working hours, benefits and other workplace policies.
However, the latest executive order amends Executive Order 12171, originally signed in 1979.
It invokes Section 7103(b)(1) of Title 5, which allows the president to exclude agencies from labor-management statutes if their primary functions relate to national security. The move effectively removes union bargaining rights for federal employees in the named agencies, impacting negotiations over workplace rules, grievance procedures and employment conditions.
This order marks a continuation of Trump’s efforts during both his terms to curtail the influence of federal labor unions, which he and allies have often accused of obstructing government efficiency.
“President Trump is taking action to ensure that agencies vital to national security can execute their missions without delay and protect the American people. The President needs a responsive and accountable civil service to protect our national security,” the fact sheet read.
